Request: Special Exception in A-1 and A-2 zones to expand Class III landfill.

Hearing: The Staff Report and Recommendation is located on Pages ____ The applicant agreed with the proposed conditions of approval. One property owner located due south of the site addressed the BZA with concerns. He stated he and his mother both have homes here and they have problems with noise and diesel fumes from the trucks coming and going from the site. The access road to the work site is close to his property line. The applicant proposed adding a tall berm between the owner's property and the work site to mitigate the noise and fume problems. The BZA formulated condition #5 to incorporate the berm requirement and also added condition #6 to relocate the access. The applicant agreed with the two additional conditions. There were no other persons present in opposition. There had been about one dozen commentaries submitted prior to the hearing with concerns about speeding trucks and the noise generated by them along Golden Gem Road. In response to that concern, staff recommend condition #3, which is the same condition that the Board of County Commissioners applied to FRBM's original 40 acre site when approved for that Special Exception and Landfill Permit in 1999.
