Summary of the decision
VA-00-05-011 — Elmer Elkins
Request: Variances in R-T-2 zone to allow three (3) accessory buildings to remain as follows: 1. garage and utility shed located in front of residence in lieu of rear yard; 2. 1,152 sq. ft. storage building in lieu of 500 sq. ft.
Decision: Approved
Hearing: The variance was initiated as a result of Code Enforcement action. The applicant built three (3) accessory buldings without permits. Two of the buildings, a garage and small utility building, are located in the front yard. These two buildings are located close to the house, which sits far back into the lot. The front yard is heavily buffered from the road. Both buildings appear well-built and are aesthetically-pleasing. The third building is a pole barn located in the backyard which the applicant uses for storage of outdoor lawn maintenance equipment and such. The applicant stated the pole barn was there when he bought the property, but that he had built the other two accessory buildings himself. He stated he has already obtained the appropriate plans for pulling the building permits. The BZA granted this request mostly because the buildings' locations on-site and their aesthetic qualities would not detrimentally impact neighboring properties.
