Request: Variances in the I-2/I-3 Zoning District to allow a 2COP license for consumption of beer and wine on premises as follows: 1) Located 316 ft. from a religious institution in lieu of 1,000 ft. 2) Located 916 ft. from a religious institution in lieu of 1,000 ft. 3) Located 960 ft. from a religious institution in lieu of 1,000 ft.

Decision: Approved

Hearing: SYNOPSIS: Staff described the proposal, including the location of the property, the site plan, and photos of the site. Staff provided an analysis of the six (6) criteria and the reasons for a recommendation for approval of the Variances. Staff noted that one (1) comment was received in favor and no comments were received in opposition to the request. Additionally, the churches, subject to the requests, provided letters of support that were submitted by the applicant with the application. The applicant was present with a translator and requested the board approve the request stating there are existing establishments that received similar requests in the same plaza and that the Churches do not object to the requests. The BZA discussed that the distance requirements should be enforced, however, there is a similar business existing in the plaza that was previously granted Variances by the BZA. The BZA recommended approval of Variance request by a 6-0 vote, with one (1) absent, subject to the three (3) conditions found in the staff report.
