Decision: Denied

Hearing: Applicant is proposing a day care center for up to 315 children. The BZA continued this case from last month to expand the notification and to allow for a second community meeting.

The applicant gave a presentation that addressed need, site design and the operation.

One resident spoke in favor. He indicated the project was needed and would provide a valuable service to the community.

Four residents spoke in opposition. They had concerns about the lack of roadway infrastructure.

Staff from Traffic Engineering and the Legal Department addressed the BZA concerning traffic conditions, concurrency review and the criteria to review this request.

The BZA discussed the evidence and testimony. Three different actions by the BZA did not result in a majority vote. Therefore, the decision was a De facto Denial.

Staff received approximately 250 commentaries in opposition and 90 in favor.
