Request: Variance in P-O zone as follows: 1. allow existing addition to remain (in violation) six (6) ft. from side (north) property line in lieu of ten (10) ft.; 2. create substandard lot with 60 ft. width and 7,500 sq. ft. of land area in lieu of 85 ft. of width and 10,000 sq. ft. of land area. (Note: Structure being used as both a residence and an office.)

Decision: Approved

Hearing: The applicant is leasing the building to a tenant who constructed an addition without permits. The addition encroaches into the side yard setback. The applicant expalined that his tenant constructed the addition during a weekend and did not think it was a problem since others have done the same on Pine Hills Road. The BZA felt strongly about the precedent approval of this request would set and about the principle of the matter. They denied the request. Staff received one (1) commentary in opposition.
