(Note: Structure being used as both a residence and an office.)

Hearing: The applicant is leasing the building to a tenant who constructed an addition without permits. The addition encroaches into the side yard setback. The applicant expalined that his tenant constructed the addition during a weekend and did not think it was a problem since others have done the same on Pine Hills Road. The BZA felt strongly about the precedent approval of this request would set and about the principle of the matter. They denied the request. Staff received one (1) commentary in opposition.
