Request: Variance in a R-1 zone to erect single family residence as follows: 1) 21 feet from front property line in lieu of 25 feet 2) 20 feet from rear of property line in lieu of 25 feet.
Decision: Approved
Hearing: The property is a square shaped lot that abuts heavy commercial uses on the north. There are other residences in the area, the majority of which are older ones. Staff noted this is a rather large lot compared to most lots in the R-1 zone, and that the Variances requested would appear to be minor. Further, it was noted there was a considerable distance between the back of the proposed house and the abutting residence to the rear. The homeowners on each side of the lot wrote in favor of the request, but the neighbor to the rear wrote in opposition. That neighbor also appeared and spoke at the public hearing. He felt the five foot Variance on the rear would create a detrimental privacy impact on his home. The district BZA member suggested the applicant erect a solid fence along the rear property line and limit the house to single story to mitigate any potential impact that abutting property owner would incur. The BZA noted this was an "infill lot", and that new housing construction would do much to improve the residential quality of this area. The applicant agreed to the conditions proposed by the district BZA member.
