Summary of the decision

VA-04-07-180 — William Pagan

Request: Variances in R-2 (residential 1-4 unit structures) zone to allow existing accessory building to remain 2.8 ft. from rear property line and 3.7 ft. from side property line in lieu of 5 ft.

Decision: Approved

Hearing: The applicant is asking for an existing detached accessory building to remain 2.8 ft. from the rear property line and 3.7 ft. from the side property line in lieu of 5 ft. The applicant was issued a Stop Work order by the Building Division for constructing a second dwelling unit on the property without the appropriate permits. The applicant stated that he had purchased the property approximately one year ago with the dwelling unit already existing and was only renovating the bathroom when issued the violation. Staff voiced concerns with respect to a possible conversion because of the existing kitchen counters and bathroom facility. The applicant requested if the building could remain for his home office and storage only. The BZA approved the request subject to (3) conditions of approval. There was no opposition present at the public hearing.
