Request: Variance in R-2 (residential 1-4 unit structures) zone to create a substandard lot 75 ft. in lot width in lieu of 80 ft. for duplex use.

Hearing: Staff reported the property owner was cited by the Building Department for electrical violations, including faulty wiring and an electrical meter that has not passed inspection. Staff recommended if the BZA approved the Variance, there should be conditions to encourage the applicant to move quickly to make the conversion and correct the violations. The applicant did not appear at the public hearing. The neighbor to the east addressed the BZA with a concern about drainage. Staff pointed out that drainage was not an issue to be addressed by the BZA but during the permitting process. The BZA discussed the case and determined there was sufficient information available to make a recommendation. The BZA noted the variance was only for 5 feet on the lot width and that the property had more than sufficient lot area to accommodate the proposed conversion. The applicant indicated in his application package that he would remove the two accessory buildings on-site, which currently violate zoning codes. The BZA discussed the time frames proposed by staff. One of the BZA members informed that the applicant was a building contractor who is well aware of the codes and is therefore capable of proceeding in a timely fashion on this project. The BZA approved the request with the conditions proposed by staff, which included time frames necessary to ensure expeditious corrective action on the applicant's behalf.
