Request: Variance in the A-2 zoning district to place a mobile home on 0.57 acres of land in lieu of 2 acres.
Decision: Denied
Hearing: The applicant wants to place a mobile home on .57 acres of land. The code requires a minimum of 2 acres for a mobile home and 1/2 acre for a conventional residence. Staff gave an analysis of the area which included the location of existing mobile homes and single family residences. In addition, staff showed mobile home approvals issued by previous Zoning Managers in the 1960's and 1970's. Staff advised the BZA that the area contains mobile homes on similar sized lots but if the BZA chose they could require this applicant and all future applicants to meet the 2 acre requirement. The applicant showed the BZA a map of where he thought the existing mobile homes were. The applicant resides on the adjacent property so he has much at stake. Staff advised the BZA that modular homes are considered single family residences not mobile homes. Four area residents spoke in opposition. They had concerns about property values and aesthetics. They expected Orange County to enforce its standards. A petition containing 38 signatures in opposition was submitted. The BZA denied the request because they felt the request was self created and the property was still able to be built with a single family residence. denial of the request did not deprive this applicant of its land use rights since a home can still be built on the property.
