Request: Variances in the R-1A zoning district as follows: 1) Variance to allow existing detached carport 3 ft. from the side (south) property line in lieu of 5 ft.; and, 2) Validate existing residence located 7.4 ft. from the side (north) property line in lieu of 7.5 ft. (Note: There are no permits on file for the carport. This is code enforcement related. The carport is open on all four sides. The applicant has obtained 18 signatures of support from residents in the area).

Decision: Approved

Hearing: Staff gave a presentation on the case. It addressed the request, the zoning in the area and a brief analysis. The applicant stated that he poured the slab, and hired a company to install the carport, and that they told him permits were not required and the setbacks were acceptable. The applicant stated that he uses the carport to store his boat and camper. He also stated that he allowed Code Enforcement on his property to view the neighbors violation, and he then got cited. Code Enforcement confirmed the neighbor called in the violation after he visited the property. Code Enforcement stated that the violation would be resolved if the variance is approved. The BZA stated that they would rather see the boat being stored on the slab, under the carport at the back, instead of in front or on the street, and that the request is minimal. Staff received 11 commentaries in favor of the application and none in opposition. There was no opposition at the hearing. The BZA approved the variance subject to the 5 conditions in the staff report.
