Request: Variance in the R-1AA zoning district to allow an existing addition with a south rear setback of 27.9 ft. in lieu of 35 ft. Note: This is the result of Code Enforcement.

Hearing: SYNOPSIS: Staff described the proposal, including the location of the property, the site plan, and photos of the site. Staff provided an analysis of the six (6) criteria and the reasons for a recommendation for approval. Staff noted that one (1) comment was received in support, and one (1) comment was received in opposition. The applicant had nothing to add. The BZA confirmed the condition that addition shall be painted the same color as the existing house, and noted the Code Enforcement Case against the property. Code Enforcement confirmed that the Case against the property has already been adjudicated and there are fines against the property. There was no one in attendance to speak in favor or in opposition to the request. The BZA discussed the variance and stated justification for the six (6) criteria and unanimously recommended approval of the Variance by a 5-0 vote, with one absent and one vacant, subject to the five (5) conditions found in the staff report.
