Summary of the decision

VA-22-02-143 — Ricardo Oliveira

Request: Variance in the R-1AA zoning district to allow the replacement of an existing screen room with a rear setback of 20 ft. in lieu of 22 ft.

Decision: Approved

Hearing: SYNOPSIS: Staff described the proposal, including the location of the property, the site plan, and photos of the site. Staff provided an analysis of the six (6) criteria and the reasons for a recommendation for approval. Staff noted that two (2) comments were received in support, and none in opposition. The applicant was present but chose not to speak. There was no one present to speak in favor or in opposition to the request. The BZA confirmed that the request is not a result of Code Enforcement action, and confirmed that if the property is sold, the new owner will not have to re-apply for another variance to re-build the screen room, and unanimously recommended approval of the variance by a 6-0 vote, with one absent, subject to the three (3) conditions in the staff report.
