Request: Variance in R-CE zone to allow construction within 50 ft. of normal high water elevation (NHWE) of Lake Estes as follows: 1. addition to single family residence 36 ft. from NHWE; 2. swimming pool (20 ft.) and retaining wall (10 ft.) from NHWE.
Decision: Approved
Hearing: Variance #1 is actually a modification to a previous BZA approval granted to the former owner for a swimming pool. The new owner, Mr. Williams, wanted to change the pool to a house addition with an additional three foot encroachment. The BZA recommended approval of this request. Variance #2 is a new request for a swimming pool and retaining wall. The BZA felt this request was too close to the lake and could set a precedent for other variances on the lake. Although there is somewhat of a narrow building window on the property, the BZA felt there was sufficient room on either side of the house to rework the plan and meet the setback requirement. The Environmental Protection Division reviewed the request and had no objections to the request. The Stormwater Management Department advised the proposed improvements would require a flood plain permit and fill. A letter in opposition was received from John Connolly with the Windermere Water and Navigation Control Advisory Board. Copies of correspondence from these parties follow this report. Three neighboring property owners wrote in favor of the request. There was no other opposition.
