Request: Variance in the P-D zoning district to allow the construction of an enclosed porch with a west rear setback of 29.6 ft. in lieu of 35 ft.

Decision: Approved

Hearing: SYNOPSIS: Staff described the proposal, including the location of the property, the site plan, and photos of the site. Staff provided an analysis of the six (6) criteria and the reasons for a recommendation for approval. Staff noted that three (3) comments were received in support and no comments was received in opposition. The applicant was not present. A member of the Homeowners Association spoke in opposition to the case. He stated that the setbacks in the restrictive covenants are the same as those required by Orange County Code. He was also concerned over an easement and stated that this will not be approved by the Architectural Review Board. The BZA confirmed that the applicant had the support of the golf course, and noted the new information from the opposition, but felt that outside of this, the case is straightforward. The BZA unanimously recommended approval of the variance by a 4-0 vote, subject to the five (5) conditions in the staff report.
