Request: Special Exception in a A-1 zone for temporary concrete batch plant (Florida Rock Industries) to include consideration of a time limit for all operations on the subject property, which consists of approximately 116.2 acres.

Hearing: "The history on this case is highlighted in the attached memorandum dated December 22, 2000, from the Zoning Manager to the BZA. The proposed Developer's Agreement is also attached. The main zoning issues of concern were discussed in detail at the BZA hearing. Those main issues centered on berming, access, traffic management, and the method and timing for phasing out the industrial uses on the 116 acre tract, located on the west side of C.R. 545. The BZA worked out a compromise that was suitable to Florida Rock, who wishes to operate the subject batch plant, the property owner Carlos Cantero (represented by his attorney Charles Carrington), Bobby Hewitt (adjacent property owner), and a representative from the Lake Avalon and Lake Hickory Nut Homeowners Associations. There was no opposition to the proposed compromise. The issues of compromise were formulated in the above conditions of Special Exception approval, which shall in turn be incorporated into the Developer's Agreement."
