Summary of the decision

VA-02-07-089 — Ercine Nozil

Request: Variance in R-1 (single family-5,000 sq. ft. lots) zone to allow addition to single family residence to remain 12 ft. from rear property line in lieu of 25 ft.

Decision: Denied

Hearing: The applicant constructed an addition without permits. Several neighbors spoke in opposition to this request. They indicated this site is being used as a multifamily unit. They indicated there were several kitchens in this home. Staff informed the BZA this site was the subject of another code enforcement violation back in 1984. At that time another addition was constructed without permits. So this request is the second request dealing with an addition that was constructed without permits. The BZA felt the request did not comply with the zoning variance criteria. Three (3) neighbors spoke in opposition to this request.
