Request: For Variances in R-1A zone as follows: 1. allow existing 876 sq. ft. accessory building to remain in lieu of 500 sq. ft. (cumulative square footage = 876 sq. ft.); 2. allow zero (0) foot rear setback in lieu of 5 ft.

Hearing: Applicant was cited by Code Enforcement for erecting a pool enclosure without a permit. When permitting for the pool enclosure Staff informed the applicant that the accessory structures on the property did not meet the size and setback requirements in the code. The applicant brought this request forward to rectify a pre-existing substandard condition. The Board of Zoning Adjustment was hesitant to approve a setback variance to allow for a zero (0) foot rear setback. The Board allowed for a 2.5 foot rear yard setback. This will require the applicant to remove a small portion of a non-permanent structure, and in so doing, the applicant must acquire permits for the accessory structures that were constructed without permits.
