Request: Variance in the PD zoning district to allow a 4COP liquor license for consumption on premises located 796 feet from a religious institution in lieu of 1,000 feet.

Hearing: SYNOPSIS: Staff described the proposal, including the location of the property, the site plan, and photos of the site. Staff provided an analysis of the six (6) criteria for the Variance, and the reasons for a recommendation for approval of the Variance. Staff noted that no comments were received in support and three comments were received in opposition to the requests. The applicant discussed the history of the plaza, the surrounding area and uses, and the need for the variance. There were no persons in attendance to speak in opposition to the request and one person to speak in favor of the request. The BZA discussed the distance separation requirements, the requested license for the new restaurant on the site, and the need for the variance. The BZA recommended approval of the variance and special exception by a 6-1 vote, subject to the three (3) conditions in the staff report.
