VA-00-06-017 — Kirkman Road Billboard Relocation

Request: Variance in C-2 zone to replace existing non-conforming billboard (non-conforming with regard to size, height, and spacing between billboards) with a new billboard which is located approximately 875 ft. and 550 ft. away from two (2) existing billboards in lieu of 1,000 ft. to the north and south, respectively. (Note: new billboard will conform to size and height requirements.)

Decision: Approved

Hearing: The subject billboard is located between two other billboards. The subject is nonconforming, with respect to size, height, and separation. The next page shows a comparison of the existing and proposed conditions. The applicant's attorney was present at the public hearing and explained the property is being sold to a company who will be building a restaurant on-site. The new owner wishes to keep the billboard, but wants to take it out of its non-conforming use status by replacing it with a billboard that more sufficiently complies with currently code. Staff noted the proposed replacement will be shorter, smaller, and more aesthetically-pleasing than the existing billboard. Staff explained that if the variance is not approved, the existing billboard is allowed to remain as is unless it is destroyed or abandoned. The BZA approved the request with the conditions proposed by Staff. The applicant agreed to the conditions. There was no opposition to this request.
