Request: Variances in the R-1AA zoning district as follows: 1) To allow an existing principal structure with a rear setback of 33 ft. from the Normal High Water Elevation (NHWE) in lieu of 50 ft. 2) To allow the construction of an addition with a rear setback of 40 ft. from the Normal High Water Elevation NHWE in lieu of 50 ft. 3) To allow an existing accessory structure (shed) with an east side setback of zero in lieu of 5 ft. 4) To allow an accessory structure (boat storage) with an east side setback of 4 ft. in lieu of 5 ft. 5) To allow an accessory structure (boat storage) with a setback of 3 ft. from the Normal High Water Elevation (NHWE) in lieu of 35 ft. 6) To allow the construction of a pool and deck with a setback of 15 ft. from the Normal High Water Elevation (NHWE) in lieu of 35 ft.

Hearing: SYNOPSIS: Staff described the proposal, including the location of the property, the site plan, and photos of the site. Staff provided an analysis of the six (6) criteria and the reasons for a recommendation for approval for Variances #1, #2 and #6 and for denial of Variances #3, #4 and #5. Staff noted that two comments were received in favor or in opposition to the request. The applicant discussed the location of other structures within the area and provided reasons for the need of the Variances. There was no one in attendance to speak in favor or in opposition to the request. The BZA unanimously recommended approval of the Variances by a 4-0 vote, with two absent and one vacant, subject to the five (5) conditions in the staff report.
