Summary of the decision
VA-19-01-182 — RALPH MERVINE
Request: Variance in the R-1 zoning district to construct an addition 10 ft. from the side street line (north) in lieu of 15 ft.
Decision: Approved
Hearing: Staff noted that the dead-end section of road ends at the back yards of two homes in a neighboring subdivision which was actually plated after the one creating the subject property. It also abuts a little league baseball complex which does not want access. Staff noted that they had received one correspondence in favor, and none in opposition. The applicant noted that the property owner had approached Public Works in the past about abandoning the road, and was told no. Then, at staff's request, the applicant did the same before applying for the variance, and was emphatically told no. There being no one present to speak for or against the request, the public hearing was closed. The BZA concluded that applicant had exhausted all options, and that the side street was not serving any purpose to warrant such a great setback. A motion to recommend approval passed by unanimous vote.
