Request: Variance in P-D (Planned Development) zone to construct single family residence 62 ft. in height in lieu of 35 ft.

Decision: Approved

Hearing: The applicant proposes to construct a three story home at the end of the cul de sac abutting the lake. He owns four lots which have been joined to create one 8-acre parcel for the homesite. The tallest portion of the house is a central roof feature at the entrance, measuring 62 feet. The balance of the variance is portions of the house at 55 feet in height. The house will be centrally located with building setbacks well in excess of the minimum requirements, ranging from 106 ft. on the front to 300 feet on the west. Several letters were received in favor of the request, including one from the developer, several neighboring property owners, and the subdivision's architectural review board. One letter was received in opposition from a home builder in the area. The BZA felt there were unique circumstances warranting the variance approval. Based on the large tract size and the manner in which the home was being developed on-site, the intensity of use would actually be less than that if the four lots were built as individual homesites. The BZA placed a condition on the variance approval to ensure the development intensity regarding the number of homes permitted would not exceed that beyond the subject residence.
