It is a small swimming pool, and there is not enough room in the back yard to shift the pool due to the location of the house on the lot. The encroachment is minor, involving only the southern portion. The pool constitutes a 1-2 foot encroachment, and the decking/screened enclosure is 3-4 foot. The encroachment was discovered when the contractor for the screened enclosure came down to pull a permit. Very little construction on the pool had taken place, and the pool company ceased any further action pending BZA action. There was no opposition to this request. The BZA felt this was a minor encroachment with no impact to adjacent home sites.
