Request: Variances in the R-2 zoning district for the construction of a 318 sq. ft. Accessory Dwelling Unit (ADU) as follows: 1) To allow a north rear setback of 1 ft. in lieu of 5 ft. 2) To allow a west side setback of 1 ft. in lieu of 6 ft.

Hearing: SYNOPSIS: Staff described the proposal, including the location of the property, the site plan, and photos of the site. Staff provided an analysis of the six (6) criteria and the reasons for a recommendation for denial of the Variances. Staff noted that two comments were received in favor and one comment was received or in opposition to the request. The owner discussed the need for the request and indicated that there were no other options to construct an ADU. There was no one in attendance to speak in favor or in opposition to the request. The BZA discussed the location of the drainfield and the septic tank, the proximity of the ADU, the location of the existing residence and unanimously recommended denial of the Variances by a 4-0 vote, with two absent and one vacant.
