Hearing: Applicant is proposing to construct 314 multi-family dwelling units with building heights of 45 feet in lieu of 35 feet. The portion of the building requiring Special Excepation is the upper portion of the roof which was indicated at the hearing. There is an existing apartment complex to the west and to the east which are part of the Waterford Lakes Planned Development. This development allows for building heights up to 45 feet in height. Staff also indicated the southern portion of the site is the beginning of the Woodbury Road fly-over of the East-West Expressway which puts the site below the finished grade of the roadway. The developer also intends to maintain the 100' building setback along the southern portion of the property due to possible development of a single family residential subdivision along the southern boundary. One commentary was received in favor and sixteen commentaries in opposition to the request. There was no opposition at the public hearing.
