Request: "Variances in the R-T-2 zoning district as follows: 1) To allow an existing detached accessory structure to be converted into a* detached accessory dwelling unit (ADU) with a living area of 284 sq. ft. in lieu of a maximum 270 sq. ft. 2) To allow an existing detached accessory structure (shed) with a west side street setback of 13.4 ft. in lieu of 15 ft. 3) To allow an existing detached accessory structure (shed) to be located in front of the principal structure. Note: This is the result of Code Enforcement. *Additional description added for clarity."

Decision: Approved

Hearing: SYNOPSIS: Staff described the proposal, including the location of the property, the site plan and photos of the site. Staff provided an analysis of the six (6) criteria and the reasons for a recommendation for denial. Staff noted that one (1) comment was received in support and no comments were received in opposition. The owners described the need for the Variances, and especially the need for the ADU. Code Enforcement discussed the initial compliant pertaining to an RV, that has since been satisfied, and the new citation pertaining to the subject requests. There was no one in attendance to speak in favor or in opposition to the request. The BZA discussed the Variances, noted that the requests were minimal, that Avenue C is not paved, that other similar variances were approved in the area, stated justification for the six (6) criteria and unanimously recommended approval of the Variances by a 6-0 vote, with one absent, subject to the four (4) conditions in the staff report.
