Request: Variance in the R-1AA zoning district to allow an addition with an east rear setback of 11.5 ft in lieu of 35 ft. Note: This is the result of Code Enforcement.

Hearing: SYNOPSIS: Staff described the proposal, including the location of the property, the site plan, and photos of the site. Staff provided an analysis of the six (6) criteria and the reasons for a recommendation for denial of the Variance. Staff noted that two (2) comments were received in favor and one (1) comment was received in opposition to the request. The applicant was present with a translator and requested the board approve the request. She stated she was not aware of the need for a permit and the space would be used as additional living area for family. There was no one in attendance to speak in favor or in opposition to the request.The BZA discussed that the applicant is working toward compliance, and the structure is partially complete. They went on to discuss that similar requests for reduced rear setbacks have been granted.The BZA recommended approval of Variance request by a 6-0 vote, with one (1) absent, subject to the five (5) conditions found in the staff report with an additional Condition of Approval #6 as follows: 6. The exterior finish and color of the additional shall match the existing structure
