Request: For modification of condition of Special Exception approval for lime stabilization facility as follows: Applicant requests a temporary extension beyond the 10/6/99 Special Exception expiration date; this extension is requested to accommodate the applicant's required permitting of relocation to its new site on Taft-Vineland Road.

Hearing: The applicant purchased a new site within Regency Industrial Park earlier this year in order to relocate the business from the subject property to there. They have been diligently pursuing the necessary permitting and licensing requirements to effectuate the move, but needed a little extra time to relocate. Therefore, they applied to the BZA for the extension. At the BZA hearing, the applicant provided qualified justification of their good faith efforts towards the relocation effort. Further, the applicant advised the BZA that all County departments had signed off on the commercial plans for the new site, and that as a result, the building permit was issued that morning. The applicant requested a 3 1/2 month extension to shut down operations (to January 14, 2000), and until April 15, 2000 to remove all equipment associated with the lime stabilization process. Prior to the public hearing, the applicant mailed a notice to all property owners within the notication area advising of their intent to move and the anticipated cessation date. There was no opposition present at the public hearing.
