Hearing: "Staff described the proposal, including the location of the property, the site plan, and photos of the site. Staff provided an analysis of the six criteria and the reasons for a recommendation for denial of the Variance request. Staff noted that three comments were received in favor and none in opposition to the request. The BZA asked staff about similar improvements in the area and setback requirements of existing improvements on the property. The applicant was present and discussed the need for the family room expansion and an ADA accessible pool bathroom within the rear addition. The applicant also discussed that there is not adequate space for a reasonable addition that also allows for wheelchair maneuverability. The BZA asked the applicant about the pavers to be removed, and the applicant discussed impervious surface concerns and wanted to make sure the property was not surpassing the allowed impervious surface ratio. There was no one in attendance to speak in favor of the request. There was no one in attendance to speak in opposition of the request. The BZA discussed the request and determined that the request was de minimis and was appropriate for the functionality of the space. The BZA recommended approval of the Variance request by a 5-0 vote, with 2 absent."
Conditions: 1) Development shall be in accordance with the site plan and elevations dated October 22, 2025, subject to the conditions of approval, and all applicable laws, ordinances, and regulations. Any proposed non-substantial deviations, changes, or modifications will be subject to the Zoning Manager's review and approval. Any proposed substantial deviations, changes, or modifications will be subject to a public hearing before the Board of Zoning Adjustment (BZA) where the BZA makes a recommendation to the Board of County Commissioners (BCC).
