The BZA did not have the ability to grant an approval on this request in that the property is the subject of a rezoning restriction that required joint access use with the abutting property. The site plan submitted by the applicant did not take into consideration the joint access restriction. Furthermore, the vehicular use area was not designed for safe adequate access and on-site maneuverability. The applicant was instructed to either amend his site plan to provide the joint access and redesign the parking area, or, file an application for public hearing by the Planning and Zoning Commission to consider removal of the joint access restriction.
