Request: Special Exception in R-1A (single family-7,500 sq. ft. lots) zone to construct a community center with the following Variances: 1) 10 ft. rear setback in lieu of 30 ft.; 2) 10 ft. side street setback in lieu of 15 ft.; 3) Allow unpaved parking in lieu of paved.
Decision: Denied
Hearing: The Staff Booklet and Recommendation is located on Pages______ The applicant wants to construct a 3000 sq. ft. metal building to be used for meetings, wedding receptions, and other social gatherings. The structure will be leased out. Staff advised the BZA this use had the potential to cause a nuisance in the neighborhood. The hours of operation were excessive and the uses were not clear. In addition, the occupancy load of the building was 9 times greater than the number of persons the applicant stated. Two (2) neighbors spoke in opposition. They had concerns about the proposed uses and one of the neighbors house was under construction adjacent to this facility. The BZA agreed this use was more appropriate in a commercial zoning district and had the potential to disrupt the neighborhood.
