Request: Special Exception in the C-1 zoning district to allow a portable food vendor at an existing gas station/convenience store. This is the result of Code Enforcement action.

Decision: Approved

Hearing: Staff gave a presentation on the case covering the location of the property and the operation, the site plan, and photos of the site. The applicant stated that they can place the operation inside of the building each night without any problem. The BZA confirmed that the gas station operated 24 hours per day, and that there were no such other operations in the area. The BZA also confirmed that if the operation was under the canopy of the building then no hearing would be required. A member of the public spoke in favor of the application, stating that the use does not affect the area and that he is happy with it. Staff received no commentaries in favor of the application, and 1 in opposition to the application. There was no opposition at the hearing. The BZA approved the Special Exception.
