Request: Special Exception in P-O zone for a beauty hair salon, restaurant (no drive thru), and a health spa fitness center.

Hearing: Staff's report on this application is located on Pages 26 through 29. A community meeting was held prior to the public hearing. Representatives from the Orange Tree Subdivision to the west were present. They had concerns primarily related to the location of the dumpster, parking lot lighting, and the restaurant use. In response to those concerns, staff drafted a set of compromise conditions, which both the applicant and the president of the homeowners' association agreed to. A total of 10 conditions were presented to the BZA resulting from the compromise. At the BZA hearing, one of the BZA members expressed concern about the sale of alcoholic beverages. The applicant stated they had no intentions of selling alcohol. Staff suggested this be added in as a condition of the Special Exception approval. There was no opposition present at the public hearing.
