Hearing: "The Staff Report is located on pages ----. In summary, there have been several public hearings regarding this proposed DTV tower, located in the Christmas area. During those hearings, the adjacent property owners to the east, Mr. and Mrs. Craig Drinkwater, opposed the project due to the proposed tower's failure to meet the tower-to-residential separation requirement from their property boundary. The applicant then filed a new site plan relocating the tower further to the west, thereby meeting the separation requirement from the Drinkwaters' property. The BZA's public hearing this date was to consider a Special Exception on the new location. The Drinkwaters sent a letter stating they would not oppose the request as long as the BZA's recommended conditions from a previous hearing regarding comitted service providers and future removal of the applicant's pre-existing tower were applied to today's Special Exception request. Staff assured the BZA both conditions (refer to conditions #4 and #5) were being recommended again. Futhermore, the BZA added a stipulation to condition #5 that required the pre-existing tower be removed within a one year time frame of FCC determination on analogue service. There was no opposition at the public hearing."
