Request: Variances in the R-1A zoning district to construct a new residence as follows: 1) To allow a 10 ft. front setback in lieu of 25 ft. 2) To allow a 4 ft. north side setback in lieu of 7.5 ft. 3) To allow a 7 ft. south side setback in lieu of 7.5 ft. 4) To allow a 6 ft. rear setback in lieu of 30 ft.
Decision: Approved
Hearing: Staff described the proposal, including the location of the property, the site plan, and photos of the site. Staff provided an analysis of the six (6) criteria and the reasons for a recommendation for denial of the Variances. Staff noted that no comments were received in favor or in opposition to the request. The applicant was present and disagreed with staff's recommendation. They stated the original plan for the property was to renovate the existing home but based on the existing on-site conditions they decided to demolish the existing home and build new construction. The applicant went on to state the proposed design matches the other new construction homes. The applicant stated the subject lot is an investment property. The BZA discussed the Variances granted for the lot width and lot area. Additionally, the property has two rear property lines further restricting the buildable area of the lot. There was no one in attendance to speak in favor or in opposition to the request. The BZA recommended approval of Variance request by a 7-0 vote, subject to the four (4) conditions found in the staff report.
Conditions: 1) Development shall be in accordance with the site plan and elevations date stamped April 10, 2025, subject to the conditions of approval, and all applicable laws, ordinances, and regulations. Any proposed non-substantial deviations, changes, or modifications will be subject to the Zoning Manager's review and approval. Any proposed substantial deviations, changes, or modifications will be subject to a public hearing before the Board of Zoning Adjustment (BZA) where the BZA makes a recommendation to the Board of County Commissioners (BCC).
