Request: Variances in R-1A zoning district as follows: 1) To allow a 334 sq. ft. shed with a 1.8 ft. east rear setback in lieu of 5 ft. 2) To allow a 286 sq. ft. shed with a 1.5 ft. east rear setback in lieu of 5 ft. 3) To allow a 286 sq. ft. shed with a 3 ft. north side setback in lieu of 5 ft. This is a result of Code Enforcement action.

Hearing: SYNOPSIS: Staff described the proposal, including the location of the property, the site plan, and photos of the site. Staff provided an analysis of the six (6) criteria and the reasons for a recommendation for denial. Staff noted that no comments were received in support and none in opposition. The applicant stated that the sheds were installed by a contractor without, and that it would be a hardship to relocate the sheds to a compliant location. The applicant cited the location of the septic system and drainfield as causing limited use of the rear yard. There were three (3) present in favor of the request. There was no one in attendance to speak in opposition to the request. The BZA recommended approval of the variances, by a 5-0 vote, subject to the four (4) conditions in the staff report.
