Request: Variance in R-2 (residential 1-4 unit structures) zone to operate a community residential home with up to 5 clients/residents within 1,000 ft. of an existing community residential home (NOTE: Proposed and existing community residential homes are adjacent to each other).

Decision: Approved

Hearing: The purpose of the separation requirement is to avoid a concentration of community residential homes in conventional residential neighborhoods. The applicant owns and operates both the existing and the proposed community residential homes. This is a family-owned operation for the elderly. The existing home has 16 elderly residents and has operated without incident since 1987. The existing operation fronts Beggs Road, and the proposed home is about 75 feet to the rear of it. The property fronts Beggs Road, a major street, and it is not oriented towards the residential neighborhood. Nine letters/commentaries were received in favor, all from property owners closest to the property. Based on the geography and the nature and character of the operation, the BZA felt this was an approvable request with conditions.
