Request: Variance in PD zoning district to allow a two-story addition with a 9 ft. south rear setback in lieu of 15 ft.

Decision: Approved

Hearing: SYNOPSIS: Staff described the proposal, including the location of the property, the site plan, and photos of the site. Staff provided an analysis of the six (6) criteria and the reasons for a recommendation for denial. Staff noted that one (1) comment was received in favor of the request from the Homeowner's Association, and no comments were received in opposition to the request. The applicant discussed the need for the request, noted the angle of the existing footprint of the house and rebutted the staff recommendation of denial, noting there is no available space on the property to construct a sizeable addition for the use of living area. There was no one in attendance to speak in favor or in opposition to the request. The BZA discussed the Variance, noted that the property is uniquely shaped and the configuration of the existing house in relation to the property boundary lines making it difficult to construct a sizeable addition to meet code and unanimously recommended approval of the Variance by a 6-0 vote, with one seat vacant, subject to the three (3) conditions in the staff report.
