Hearing: "Staff noted that the pool had been properly permitted. However, while the required five (5) ft. setback had been referenced, staff had overlooked the 7.5 ft. utility easement extending across the rear property line. While the pool contractor installed the pool .7 ft. to close to the rear property line, the pool also sits over 2.5 ft. into the easement. The applicant provided letters from all utility providers in the area noting that they have no utilities in the easement and have no plans to install any. Staff concluded by noting that the applicant had obtained 15 letters of support from all three (3) abutting property owners and 12 neighboring property owners.
