Staff provided an analysis of the six (6) criteria and the reasons for a recommendation for approval. Staff noted that one (1) comment was received in support and one (1) comment was received in opposition. The applicant agreed with the staff recommendation and noted that they would not operate year round, but rather during public school breaks. The BZA questioned the need for the restrictions pertaining to the hours of operation and the maximum number of children, and inquired about the applicant renting out the property. Staff discussed the site plan submitted, the number of existing parking spaces provided and the need to require a cap to operations due to site restraints. The applicant stated that they wanted to keep the operation small, and that the daycare did not survive the pandemic and they were looking for a new operator. There was no one in attendance to speak in favor or in opposition to the request. The BZA unanimously recommended approval of the Special Exception, subject to the six (6) conditions in the staff report.
