Request: Variances in R-1A zone or additions to single family residence (renovation project) as follows: 1. Convert carport and building to bed and bathroom addition 8 ft. 4 inches from side street to the north in lieu of 15 ft.; 2. Garage addition 21 ft. from rear property line in lieu of 30 ft.

Decision: Approved

Hearing: As to Variance #1, these structures already exist in nonconforming use status with respect to the side yard setback. The renovation project involves the enclosure and conversion of those structures for additional living area for the residence. Variance #2 is new construction (garage) added to the back of the building in Variance #1. The garage will line up with the existing building on the side street and requires an additional variance on the rear. The applicant clarified the setback requested in Variance #2 was initially 21 feet (as indicated in the cover letter), but in actuality will be 25 feet as indicated on the site plan. The property owner to the rear (west) spoke in opposition, stating he was concerned the proposed addition would block his view of the lake. The Board studied the site plan and the photographs of the property. The district board member commented the rear setback requested was a minor encroachment. Further, given the fact that the lot is a double frontage lot with more restrictive setbacks than those lots along Salisbury Drive, there appeared to be more than adequate space between the proposed addition and the next door neighbor's house. The Board approved the Variance request with the condition the subject construction be within the parameters of the site plan specific.
