Summary of the decision
SE-03-07-041 — Aaron Gorovitz for Kamlesh Shah
Request: On June 25, 2002, the Board of County Commissioners (BCC) approved a religious use facility on this property (7819 Lilwill Avenue). Condition of approval #9 states "In one year, a public hearing shall be conducted by the BZA to revisit this Special Exception application to review the success or failure of the trial conditions of approval and to decide whether to recommend to the BCC that the Special Exception approval be extended or made permanent." This request is pursuant to that condition.
Decision: Approved
Hearing: "The Staff Report and Recommendation is located on Pages____. Last year the Board of County Commissioners (BCC) approved a special exception to allow this structure to be used for religious purposes. One of the conditions required the applicant to re-apply to the BZA for permanent approval if they complied with the conditions during the past 12 months. Staff gave its presentation and concluded the applicant did in fact comply with the BCC conditions of approval. Staff recommended the approval be made permanent. The applicant submitted a petition signed by numerous property owners surrounding the site. The commentaries received indicated the applicant's use was non-obtrusive. The BZA approved the use as a permanent use subject to the other BCC conditions of approval. There was no opposition at the hearing."
