Request: Variance in C-1 (retail commercial) zone to allow on-site consumption of alcoholic beverages (beer, wine & liquor) in conjunction with proposed restaurant (Maria Bonita Mexican Food) within 500 ft. of a church (Storehouse Ministry of Orlando, Inc. at Murdock Boulevard) in lieu of 1000 ft.
Decision: Approved
Hearing: The applicant has the same restaurant in Daytona Beach. Letters of commendation were received from Daytone Beach City officers and from the church impacted by this request. Several commentaries were received in favor. There was no opposition. The property was the site of Murray's Restaurant, which had the same alcoholic beverage license, which existed prior to the church moving in. Murray's went out of business, and the building remained vacant for many months, negating any "grandfather" rights associated with the beverage license. The BZA felt the variance was logical, given the former license holding by Murrays, the fact that the applicant had a bonafide restaurant business, and the church had no objection.
