Hearing: SYNOPSIS: Staff described the proposal, including the location of the property, the site plan, and photos of the site. Staff provided an analysis of the six (6) criteria and the reasons for a recommendation for denial. Staff noted that no comments were received in support, and no comments were received in opposition. The applicant stated that he did not know it could not go 6 feet further. The BZA noted that the house does not have back yard access, and that the front is cooler at sunset, and confirmed that there is no HOA and noted that the trim is painted to match the house. There was no one in attendance to speak in favor or in opposition to the request. Code Enforcement stated that the case came in as a complaint due to construction noise. The BZA discussed the variances and stated justification for the six (6) criteria and made a motion to approve the variance which passed with a 4-1 vote, with two absent, subject to the four (4) conditions found in the staff report.
