Request: Variance in the PD zoning district to allow pool equipment with a west side setback of 1 ft. in lieu of 5 ft.

Decision: Approved

Hearing: SYNOPSIS: Staff described the proposal, including the location of the property, the site plan, and photos of the site. Staff provided an analysis of the six (6) criteria and the reasons for a recommendation for denial. Staff noted that one (1) comment was received in support of the request, and no comments were received in opposition. The applicant noted it was an oversight in the installation of the pool equipment in a different location than what was indicated on the site plan submitted for the permit. There was no one in attendance to speak in favor or in opposition to the request. The BZA discussed the request determining it allows for the sidewalk, is not setting precedence, and the neighbor most effected is in support, and unanimously recommended approval of the Variance by a 5-0 vote, with two absent, subject to the three (3) conditions in the staff report.
