Request: Special Exception in R-CE zone for a child day care facility (up to 100 children) and Variance to construct day care facility within 1,000 ft. of an existing day care facility (La Petite Academy to the northwest).

Hearing: Staff presented its findings. Staff informed the BZA the request was not consistent with the Comprehensive Policy Plan and did not comply with both the Special Exception and Variance criteria. The property is located outside the boundaries of the CVC. Staff felt the commercial uses violated the requirements of the CVC and would set an undesireable precedent. The BZA agreed. Five (5) area residents were present. They were in opposition. A certified land planner gave testimony against the approval of the request.
