Request: Special Exception in R-3 zone for parking use in conjunction with a commercial business and a Variance in R-3 and I-2 zones to allow a driveway for commercial use on a residential roadway.

Hearing: Cox Radio is constructing a paved parking lot and retention areas on the Rosemont Baptist Church parcel to the immediate north. This requires Special Exception approval since the church parcel is zoned residential. The residents of Bay Lake to the west are opposed to this request. They feel the proposed improvements are industrial uses and should be located entirely on the Cox Radio parcel. They are requesting that the driveway on Heatherington Road be closed and a 6 foot high block/brick wall be constructed along the entire length of Heatherington Road. Cox Radio feels the proposed improvements are not industrial uses and, therefore, should not require a block wall along Heatherington Road. In addition, the driveway should remain opened for the Rosemont Baptist Church's use. Staff informed the BZA that both the Cox Radio parcel and the Rosemont Baptist Church parcel are designated for industrial use on the County's Future Land Use Map. As a compromise, the BZA required the closure of the driveway on Heatherington Road both instead of requiring a 6 foot high wall, they required extensive landscaping.
