Request: Variances in the I-1/ I-5 zoning district to allow the construction of a building for manufacturing as follows: 1) To allow a north side setback of 17.8 ft. in lieu of 25 ft. 2) To allow a south side setback of 5 ft. in lieu of 25 ft.

Hearing: SYNOPSIS: Staff described the proposal, including the location of the property, the site plan, and photos of the site. Staff provided an analysis of the six (6) criteria and the reasons for a recommendation for denial. Staff noted that no comments were received in support, or in opposition. The applicant stated that he is renting a shop and wants to build. He stated that he did not know about zoning, but discovered that C-3 allows uses such as a muffler and body show with painting, but does not allow his use which is building cabinets without any painting. He further stated that he was recommended to rezone the property, but did not realize that the setbacks would change, as the proposed building would have complied with the C-3 setbacks. He confirmed that a 2 story building was not an option. He stated that the neighbors were in favor of the request and submitted 2 letters in favor from neighbors at the meeting. There was no one present to speak in favor or in opposition to the request. The BZA noted that the lot is uniquely shaped and that if the property had not been rezoned then the variances would not be required. The BZA acknowledged that the applicant had reduced the size of the building, and noted that the proposal will add value to the neighborhood. The BZA recommended approval of the variance by a 4-0 vote, subject to the three (3) conditions in the staff report.
