Request: Variances in the C-2 zoning district to validate an existing accessory structure (metal building) as follows; 1) 1.6 ft. from the rear (south) property line in lieu of 15 ft.; and, 2) 1.6 ft. from the side (west) property line in lieu of 5 ft.
(Note: This application is the result of code enforcement action. The structure in question was constructed in the early 1980's)
Decision: Approved
Hearing: The applicant was cited for having trash, debris and inoperable vehicles on the site. They were also cited for not having building permits for the metal building located at the rear of the site. The subject variance is for the metal building located at the rear.
The Code Enforcement Officer addressed the BZA. She indicated the property owner has cleaned up the debris and inoperable vehicles from the site. The only remaining issue is the location of the metal building.
The applicant's attorney advised the BZA his client constructed the building in the early 1980's. Since then the adjacent properties were developed. His client operates a used car dealership. It existed before the tenants on either side. His client has cleaned up the site.
A representative of Lazy Boy located to the west spoke with concerns about the sightliness of the property. The BZA advised this person that they leave such issues to the Code Enforcement Division.
The BZA concluded the conditions were reasonable and the applicant has worked in good faith with Orange County to clean up the site.
