Request: Variance in R-CE (single family-1 acre lots) zone to construct a swimming pool with screen enclosure 20 ft. from the normal high water elevation (NHWE) of Lake Tibet Butler in lieu of 50 ft.
Decision: Approved
Hearing: The applicant wants to install a pool and pool enclosure 20 feet from the normal high water line of the lake. Staff gave an overview of the area. Eleven variances had been granted in this area but all but one was for single family homes, not pools. The one that was granted for a pool was for 30 feet from the NHWE. Staff recommended the pool be built 30 feet from the NHWE to be consistent with the other variance that was granted. The applicant gave a thorough presentation and demonstrated why the pool could not be built at the 30 foot mark. The BZA felt the pool could be relocated 5 feet further away from its proposed location. Staff presented 2 letters from 2 environmental organizations which were in opposition to the request. The letters were concerned with the water quality of the Butler Chain of Lakes. The BZA approved the variance at 25 feet instead of 20 feet. There was no opposition at the hearing.
